Why preservation matters
The duty to preserve attaches the moment litigation is reasonably anticipated. Demand letter on the desk. Complaint filed. Regulatory inquiry. Once that line is crossed, routine deletion, retention cycling, and ordinary disposal can become spoliation. Courts have sanctioned firms whose preservation practices fell short of FRCP 37(e) and the Sedona Conference Commentary on Legal Holds. The fix is straightforward: act early, scope the hold defensibly, notify custodians on the record, and keep a clean audit trail you can produce later.

What does Hintyr block once a hold is active?+
Destructive operations are blocked: deleting files, deduplication, custodian removal, and overwriting an original. Additive operations stay available: you can keep uploading new documents, create sibling redactions, and re-classify privilege with a written justification. Every blocked attempt and every additive action gets written to the audit log.
Does Hintyr preserve email or storage in other systems?+
No. Hintyr preserves the documents already in your case. Preservation in Microsoft 365, Google Workspace, Slack, and other third-party systems is your firm's responsibility. Hintyr surfaces a checklist where you record what you've enabled in each external system, so the audit log shows you addressed it.
Can opposing counsel verify the audit log on their own?+
Yes. When you release the hold, the export bundle includes a signed copy that recipients can verify with stock open-source tooling. Verification instructions ship inside the bundle. Recipients confirm the package came from Hintyr and has not been modified since export, without needing to call back.
